Terms and Conditions

1. INTRODUCTION

These Terms and Conditions for Majestic Million scratchs card games (the “Terms”) apply when you play any Majestic Millions scratch card game (“scratch card”). Each scratch card may have its own specific game procedures, and you should review the physical scratch card itself for any specific instructions. All Majestic Millions scratch cards are issued by  Game and Win Entertainment LLC a company registered in Abu Dhabi. (“Majestic Millions”, “we”, “us”).

2. BUYING SCRATCH CARDS

 Scratch cards will not be sold separately. Sale is only authorized alongside preapproved Majestic Millions products. Each scratch card must be bought for its full price and , unless scratch cards are given away for free by us or a retailer authorised by us in a promotion. Scratch cards can only be bought from Majestic Millions or its authorised retailers, in line with these Terms. There is no general right for a person to buy a scratch card. Majestic Millions or any retailer can refuse to sell a scratch card without giving a reason.On receiving a scratch card, you must check that the scratch card has not been scratched off, damaged, mutilated, altered or tampered with, and that it is not defective in any way.To be eligible to purchase a scratch card you must be at least 21 years of age. No refunds or returns of scratch cards will be permitted at any retailer in any circumstances.

 For the avoidance of doubt, Majestic Millions is not a financial institution and the Credits do not constitute “Stored Value” or “E-money” as defined under applicable laws. Majestic Millions does not receive, hold, process or transfer any funds on your behalf.

 3. RESPONSIBILITIES

You are responsible for keeping your scratch card safe and in good condition. The scratch card must always be presented when claiming a prize – if you do not present the scratch card, the prize will not be paid. You are also responsible for claiming (and checking you receive) the full amount of any prize you are entitled to.

Neither Majestic Millions nor any retailer will be responsible for:

- Loss, theft, mutilation, destruction or degradation of, or damage to, any scratch card.

- Any mistakes or omissions in respect of data recorded or not recorded on any scratch card or

- Any loss of whatever nature suffered or incurred by any person as a result of any of the above affecting the scratch card.

 4. OWNERSHIP

Only one player can be the owner of a scratch card for the purposes of these Terms. The right to a prize is not transferable.   

Subject to these Terms (including the validation procedures):

- If a name and nationality is written on the back of the Scratch card, the owner of the scratch card will be the person whose name and nationality is listed.

- If no name and nationality is written on the back of the scratch card, the scratch card will be void.

5. CLAIMING A PRIZE

You can only claim a prize if you are the owner of a winning scratch card, and you have that scratch card with you at the time you claim the prize. You must have filled out your name and nationality on the back of the card.

In order to claim your prize from a retailer, the scratch card must be received by the retailer authorised to pay the prize during the retailer’s normal business hours. If the prize amount is AED 5,000 or under, then the retailer will provide the prize to you in cash.

If the prize amount is over AED 5,000 then you agree that Majestic Millions and the retailer will arrange for alternative delivery of your prize, such as via cheque, bank transfer. Any costs associated with paying you your prize, such as bank transfer charges, will be deducted by us from your prize amount. We may offer alternative methods of collecting your prize from time to time.

In case of winning the Jackpot (AED 1,000,000), the authorised retailer has the right to retain the winning scratch card in order to process the prize delivery.

The retailer will notify you of the process and timeline for delivery for the prize amount at the time you claim your prize.

6. VALIDATION REQUIREMENTS

Before a prize can be paid on a scratch card presented for payment, the scratch card must be successfully validated in line with our validation procedures adopted from time to time. Each scratch card will be printed with a unique validation number which enables it to be verified by us as a winning scratch card or otherwise (“Validation Number”).

A decision by the retailer or us about whether the scratch card presented is valid will be final and binding and made at either the retailer’s or our, as applicable, complete discretion.

Majestic Millions decision will be the final decision.

Majestic Millions or a retailer will declare a scratch card presented for validation invalid and will not, therefore, pay any prize if:

- We reasonably believe the scratch card presented (has been stolen).

- The scratch card presented is not on any list held by the retailer or us of the scratch cards issued for that game

- We reasonably believe the scratch card presented is counterfeit, has been forged in whole or in part or fails to pass our validation and security tests.

- The scratch card presented was purchased more than three months before being presented.

- The Validation Number on the scratch card presented is not on our official list of Validation Numbers of winning scratch cards, or a winning scratch card with that Validation Number has been paid previously.

- The Validation Number does not match the play symbols or prize symbol on the scratch card presented and/or is not printed in the correct symbol font or

- We or the retailer reasonably believes that the scratch card was bought in contravention of the eligibility requirements of these Terms or your claim for a prize has not been made in good faith.

- We may also declare a scratch card presented for validation invalid (and, accordingly, will not be obliged to pay any prize), if:

- The scratch card presented is damaged, defective, misprinted, mutilated, altered, unreadable, incomplete or has been tampered with in any manner.

The scratch card presented has not been issued or sold in an authorised manner by us or a retailer.

The symbols, captions or Validation Number or any other unique feature of the scratch card presented do not match precisely with the artwork we have for that game.

The Validation number of the scratch card has been tampered with in any manner.

- We can keep any scratch card given to us or a retailer for validation purposes.

7. PAYMENT OF PRIZES

We reserve the right to:

- Pay prizes by cheque, or direct transfer, or other method as we inform you from time to time

- Withhold a prize until it is entirely satisfied that a scratch card is valid, and the claim has been made in good faith.

Withhold a prize (or recover or seek to recover a prize already paid) until we have carried out all appropriate enquiries, if in our discretion we believe that the scratch card holder is not the rightful owner of that scratch card or otherwise lawfully entitled to claim the prize, or where there is any other reason for us to question entitlement to the prize.

- Withhold a prize if you are unable to produce or fail to produce proof of identity when claiming a prize.

- Neither we nor any retailer will be responsible or liable to a person claiming an interest of whatever nature in a lost or stolen scratch card.

- We will use our reasonable efforts to carry out and ensure that retailers, or others responsible for paying prizes, carry out reasonable and appropriate identity checks and other security measures in relation to payment of any prize amount; however, we will not be responsible or liable to any person claiming a prize which has been paid to a person who assumed the identity of the relevant scratch card holder.

- We will not be liable to pay a prize on a scratch card which we know, or suspect has been resold or otherwise transferred by way of trade.

- No interest will be payable on any prize, including without limitation whilst any checks or enquiries are carried out in relation to a scratch card presented for payment, or whilst a dispute about the scratch card, entry or prize claim is being resolved.

8.FOUND SCRATCH CARDS/ DISPUTE RESOLUTIONS

If you find a scratch card that:

- Does not have a name or address or other indication of ownership (or it does, but the information cannot be read, is inaccurate or is incomplete so you are unable to return the scratch card to its rightful owner); and

- Is a winning scratch card,you should immediately call the Majestic Millions team on +971 553423972.

- The scratch card should be sent with a covering note that states your name, address and contact number as well as any information about how and where the scratch card was found and what steps you have taken to return the scratch card to its owner.

- If the process above has been followed and the scratch card is a winning scratch card, provided that:

- We are satisfied, after carrying out any appropriate investigations, that you took all reasonable steps to return the scratch card to its owner before sending it to us and we are satisfied that the scratch card was lost by or stolen from the rightful owner and then found by you and you are acting in good faith,we may, at our discretion, within a reasonable time, pay you the prize.

9.INFORMATION ABOUT WINNERS

Except as required by law, we shall not disclose the identity of any prize winner without that winner’s prior written consent. If you win a prize, you understand and accept that we may, if required by law, provide a third party with details of any prize claimed by you or on your behalf, or paid to you.

10.GAME CLOSURES / DISPUTE RESOLUTIONS

We can announce the closing date for an individual game and may suspend or withdraw a game (in our absolute discretion), at any time.

Information on game closures, and the period within which prizes must be claimed following closure of an individual game, will be available at retailers and at majesticmillions.ae.

11. LIMITATION OF LIABILITY

Retailers are authorised by us to issue scratch cards, to pay certain prizes for winning scratch cards and to display and/or have available information produced by us in relation to the games. Retailers are not authorised by us to carry out any other acts or make any statements, representations or admissions whatsoever (unless agreed in writing with us).

Our only obligation is to pay the prizes won in any game to the rightful owners of winning scratch cards in the circumstances set out in these Terms. Neither us nor any retailer will be liable in any circumstances for any loss of whatever nature other than, the non-payment of a prize you are entitled to in accordance with these Terms.

But without limitation, neither us nor any retailer will be liable for any loss of profits, special, indirect or consequential loss suffered or incurred by you (or any holder or owner of a scratch card, any person claiming a prize or anyone else) that arises out of the withdrawal of any game or from the participation or non-participation of you or any person in any game. This includes the loss, for whatever reason, of the chance to participate in that game.

Neither us nor any retailer will be liable to any person for:

- Events beyond our reasonable control and expectations (for example war, strike, lockout, industrial action, fire, flood or drought, act of God or act of government).

- Any mistakes caused by all or part of the computer systems or records of us or any third party.

- Any other action or event which prevents or hinders the issue of a valid Scratch card

- The refusal to sell a scratch card to any person in line with these Terms or to allow any person to play a game.

- Except that nothing in these Terms excludes or limits (a) any person’s liability for (i) fraud; or (ii) death or personal injury caused by breach of any duty that person may have to take reasonable care or exercise reasonable skill; or (b) any other liability which cannot lawfully be excluded or limited. Subject to the foregoing, our aggregate liability in contract, tort (including negligence or breach of statutory duty) misrepresentation or otherwise in connection with these terms shall not exceed AED 500.

12.MAJESTIC MILLIONS RESPONSIBILITY TO PAY PRIZES

Majestic Million’s decision about whether a scratch card is a winning scratch card (or in relation to any other matter or dispute that arises out of the payment or non-payment of prizes) will be final and binding. Without limiting the effect of the previous sentence, following any such decision made by us, we may (in our discretion) reimburse the cost of the scratch card or replace the disputed scratch card with a scratch card for any current game of the same price.

This remedy will be the player’s sole and exclusive remedy, and any reimbursement or replacement will fully discharge us from any liability in respect of such a dispute. We will not be liable to pay any interest in respect of any reimbursement.

We may withhold payment of a prize and/or make an equivalent payment into court until any dispute has been resolved.

13.GENERAL

Any person who obtains a scratch card or submits a scratch card for validation or who claims a prize in whatever capacity, agrees to be bound by the provisions of any applicable laws, these Terms, and any information on the relevant scratch card (all as amended from time to time) and any other rules or procedures Majestic Million may issue in respect of the game.

We reserve the right to change these Terms without notice, from time to time at our sole discretion.

If any part of these Terms is deemed invalid, void, or for any reason unenforceable, that unenforceable term will be deemed severable and will not affect the validity and enforceability of any remaining terms and conditions.

You may not assign or otherwise transfer (in whole or in part) your rights and/or obligations under these Terms. We may assign or otherwise transfer its rights and/or obligations under these Terms in whole or in part to any third party at its sole discretion.

15. GOVERNING LAW

These terms and conditions are governed by and construed in accordance with the laws of the United Arab Emirates as applicable in the Emirate of Abu Dhabi, and the courts of the Emirate of Abu Dhabi, United Arab Emirates shall have exclusive jurisdiction to settle any dispute which may arise out of or in connection with these Terms.
